1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and MALMART INDIA PROJECTS PRIVATE LIMITED ("Malmart", "we", "our", "us"). By downloading, installing, or using the Malmart mobile application or website www.malmart.in, you agree to be bound by these Terms.

If you do not agree to these Terms, you must immediately discontinue use of the Platform.

2. About Malmart

Malmart is a B2B and B2C platform for the procurement of construction and building materials. We connect buyers with suppliers across Telangana and beyond.

3. Eligibility

You must be at least 18 years of age to use this Platform
You must have the legal capacity to enter into a binding contract under Indian law
If registering on behalf of a company or firm, you warrant that you have authority to do so
Accounts may not be created for unlawful purposes

4. Account Registration

To place orders or access certain features, you must create an account. You are responsible for

Maintaining the confidentiality of your login credentials
All activities conducted under your account
Providing accurate and current information during registration

Notify us immediately at info@malmart.in if you suspect unauthorized use of your account

5. Products and Orders

5.1 Product Listings

Product descriptions, specifications, images, and pricing on the Platform are for reference purposes. While we endeavour to keep information accurate, Malmart does not warrant that all listings are error-free.

5.2 Order Placement

Orders are subject to product availability and price confirmation at the time of purchase
Malmart reserves the right to cancel or modify orders in case of pricing errors, stock unavailability, or fraud suspicion
Order confirmation via email or SMS does not guarantee final acceptance; we will notify you of any changes

5.3 Pricing and Payment

All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise
Prices may change without prior notice
Payments are processed through secure third-party gateways; we do not store payment card information
Malmart is not liable for payment failures caused by your bank or payment provider

6. Delivery

Delivery timelines are estimates and may vary due to logistics, weather, or force majeure conditions
Risk of loss and damage passes to you upon delivery to the specified address
You must inspect materials at the time of delivery and report any visible damage immediately
Malmart shall not be responsible for delays caused by incorrect delivery information provided by you

7. Damaged Materials

In exceptional circumstances where supplied materials are found to be damaged:

Damaged materials may be returned at the time of delivery or within the period specified in the Refund & Cancellation Policy
Claims for damaged goods must be supported by photographs or documentation
Malmart reserves the right to assess and verify damage claims before accepting returns
Replacement or credit note will be offered at Malmart's discretion; cash refunds are not available

8. Intellectual Property

All content on the Platform, including logos, text, images, product data, software, and design, is the exclusive property of Malmart or its licensors and is protected under Indian copyright and intellectual property laws. Unauthorised reproduction, distribution, or commercial use is strictly prohibited.

9. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful or fraudulent purpose
Attempt to gain unauthorised access to our systems
Scrape, copy, or reproduce content from the Platform without consent
Post false reviews, ratings, or misleading information
Engage in any activity that disrupts the Platform's operation
Resell or exploit access to the Platform without prior written consent

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Malmart disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Malmart does not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

11. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Malmart's total liability for any claim arising out of or related to the Platform or these Terms shall not exceed the amount paid by you for the specific order giving rise to the claim. We shall not be liable for indirect, incidental, or consequential damages.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Secunderabad / Hyderabad, Telangana.

13. Modifications

Malmart reserves the right to amend these Terms at any time. Continued use of the Platform after modifications constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically
